Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of BloomHive at https://bloomhiveai.com, operated by BloomHive (“BloomHive,” “we,” “us”).

By accessing or using BloomHive—including signing in with Google—you agree to these Terms. If you do not agree, do not use the service.

The service

BloomHive is web software that helps florists plan events, build recipes, price work, create proposals, and prepare order lists. Features may change as we improve the product. We may also offer client agreement e-signature through a third-party provider when that capability is available for your account.

BloomHive is currently offered as an early-access / pilot product. Availability, features, and pricing may change. Some accounts may be free; others may be charged a fee for continued access. Fees may be collected outside the product (for example by invoice, Venmo, bank transfer, or another method we agree with you), or through in-product checkout if we add that later. We will describe applicable fees in the product or related communications before charging you.

Accounts

Access requires signing in with Google. You are responsible for activity under your account and for keeping access to your Google account secure. You must provide accurate information and use BloomHive only for lawful business purposes.

We may suspend or terminate access if we reasonably believe you have violated these Terms or misused the service.

Your content and data

You retain ownership of the content and business data you enter into BloomHive (for example, events, recipes, quotes, and client or venue details you choose to store). You grant us a limited license to host, process, and display that content solely to provide and improve the service.

You are responsible for having the rights to store and use any client, venue, or other third-party information you enter. Do not upload unlawful, harmful, or infringing content.

Acceptable use

You agree not to misuse BloomHive, including attempting to break security, reverse engineer the service except where allowed by law, overload infrastructure, scrape in a way that harms the service, or use the product to violate applicable law.

Third-party services

BloomHive depends on third parties such as Google (sign-in), Supabase (backend), analytics providers, and optionally AI providers for certain features. When e-signature is available, we may also use a provider such as SignWell. Your use of those services may be subject to their terms. We are not responsible for third-party services we do not control.

Disclaimer of warranties

BloomHive is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that quotes, costs, or order lists will meet any particular business outcome.

Limitation of liability

To the fullest extent permitted by law, BloomHive and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the service.

Our total liability for any claim arising out of or relating to these Terms or BloomHive will not exceed the greater of (a) the amounts you paid us for BloomHive in the twelve months before the claim, or (b) one hundred U.S. dollars (US $100), if you have not paid us.

Changes and termination

We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes constitutes acceptance of the updated Terms.

You may stop using BloomHive at any time. We may modify or discontinue the service, including for early-access users, with or without notice where permitted by law.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Courts located in California will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law.
